Bromley Landowner Convicted of Breaching Untidy Land Notice


A landowner in the London Borough of Bromley has been convicted of ignoring a statutory notice to tidy up his land.

Tomasz Kmiecik was served a notice under section 215 of the Town and Country Planning Act 2015, requiring him to remove rubbish - notably garden waste, a settee and a washing machine - from his land at Lullingstone Close, St Paul's Cray.

Kmiecik failed to comply with the notice within the 28 day statutory time frame, so Bromley Council commenced a prosecution against him under section 216 of the Act. He was requisitioned to attend Bromley Magistrates' Court on 15th August 2018, but failed to attend.

The court was satisfied at the good service of the requisition and the Council asked for the case to go ahead in Kmiecik's absence. Not surprisingly, he was found guilty of not complying with the notice and was hit with fines and costs totalling £1,548.

Councillor Kate Lymer, Executive Councillor for Public Protection and Enforcement said: "Landowners need to be take responsibility for clearing their land.

"Not only can it be unsightly but it can also encourage others to dump rubbish, something no one wants.

"We always give ample time for the rubbish to be cleared and in this example, virtually a year has elapsed since we became aware of the rubbish. Further action will follow if this proves necessary."
