A Darlington man has been convicted of exposure after masturbating in plain sight of a nurse.
Kelvin Ross Porter, 41, of no fixed abode, admitted charges of exposure and criminal damage when he appeared at Newton Aycliffe Magistrates' Court on Wednesday, 25th November 2020.
Exposure is an offence under section 66 of the Sexual Offences Act 2003. The maximum penalty is 6 months' custody and/or an unlimited fine on summary conviction; 2 years' custody on conviction on indictment. Criminal damage is an offence under section 1 of the Criminal Damage Act 1972. Where the value of the damage is less than £5,000, as in this case, the maximum penalty on summary conviction is a fine at level 4 (currently £2,500) and/or 3 months' custody.
Magistrates heard that Porter, who appeared in custody, was arrested for damaging a window the previous day. He exposed himself to a nurse who was present at the police station.
Ansab Shan, prosecuting, outlined the circumstances of the offences.
"The defendant used a glass alcohol bottle to damage a window at Darlington Magistrates' Court", explained Mr Shan.
"On the same day whilst in a police cell the defendant noticed a mental health nurse standing in the doorway and began masturbating in front of her.
"This caused her to feel shocked and disgusted by his actions."
Amrit Jandoo, mitigating, told the bench: "He does not recall a great deal of it, and tells me that he carried out the offence in order to get himself into custody because he is homeless.
"Obviously the sexual offence is the most serious matter."
Magistrates adjourned the case for the preparation of a pre-sentence report.
Porter was remanded in custody until his sentencing at the same court on Friday, 18th December 2020.
