Unreasonable Chastisement: Cheshire Mother Pulled Adult Daughter's Hair

A Cheshire woman has been convicted of pulling her adult daughter's hair.

Kirstie James, 53, of Kelsborrow Close, Davenham, admitted an offence of assault by beating when she appeared at Warrington Magistrates' Court on Wednesday, 21st May 2025.

Assault by beating, an offence contrary to section 39 of the Criminal Justice Act 1988, has a maximum sentence of 26 weeks' custody on summary conviction. You can read more about this offence in my earlier article.

Magistrates heard that James and her daughter were involved in an altercation, which involved the 53-year-old grabbing her daughter's hair and pushing her to the ground.

Once on the ground, James is said to have dragged her daughter side-to-side by the hair.

Magistrates were of the view that the matter could be dealt with by way of a financial penalty.

James was fined £200.

She was also ordered to pay £80 surcharge and £85 prosecution costs.

It would appear that an award of compensation was deemed inappropriate in the circumstances.
