Reminder: Mizzy CBO Breach Sentencing Hearing

The TikTok creator and social media influencer Mizzy will be sentenced for two breaches of his criminal behaviour order on Tuesday, 21st November 2023.

The sentencing hearing is listed for 10 am at Thames Magistrates' Court.

Mizzy, real name Bacari-Bronze O'Garro, was convicted of two breaches of a criminal behaviour order following a trial at Stratford Magistrates' Court on Thursday, 26th October 2023.

He was cleared of two further breaches of the order.

The order, which was made on Wednesday, 24th May 2023, contained the following prohibitions:

  • Not to upload video footage of any person to the web without their explicit consent;
  • Not to enter or access private property without the prior consent of the owner, occupier or person in charge;
  • Not to enter the Westfield Stratford City shopping centre.

The first breach took place on Wednesday, 24th May 2023, just a few hours after the order had been made. The cocky 19-year-old filmed himself riding a bicycle through Westfield Stratford City and exclaiming to the camera "I am not meant to be here".

The second breach took place on Friday, 7th July 2023, when video footage was uploaded to O'Garro's Snapchat account without the explicit consent of those featured in it.

District Judge Matthew Bone, presiding at the trial, told O'Garro: "I found it to be an intentional, immediate and deliberate challenge to the criminal behaviour order."

Addressing the unemployed father-of-one, he said: "You need to understand the seriousness of your situation now.

"You need to understand that you deliberately flouted this court order within hours of it being made."

The maximum penalty for breaching a criminal behaviour order is 6 months' imprisonment and/or an unlimited fine on summary conviction; or 5 years' imprisonment and/or an unlimited fine on conviction on indictment.

As O'Garro has been convicted of two breaches, the court has a sentence of 12 months' imprisonment available. If it considers 12 months insufficient, it could send the matter to the Crown Court for sentencing.

Update (21/11/23): O'Garro has now been sentenced.
