A Ramsbottom poo slinger has caused a right stink by fouling his neighbour's garden gate.
John Howard, 53, of Market Street, Ramsbottom, Greater Manchester, admitted an offence of criminal damage when he appeared at Blackburn Magistrates' Court on Friday, 8th November 2024.
Criminal damage is an offence under section 1(1) of the Criminal Damage Act 1971. Criminal damage below £5,000 is a summary offence, with a maximum penalty of 3 months' custody and/or a fine at level 4. Julia Draper, prosecuting, described the events of Tuesday, 13th August 2024. It was a warm summer's day and on entering her garden one of Howard's neighbours was immediately hit by the foul stench of dog waste.
On checking her home CCTV system, the neighbour saw Howard loading up a shovel with dog waste and projecting it over the garden fence. Some of the waste ended up splattered onto the lady's garden gate, which required cleaning.
Howard, representing himself, told the court that he had been cleaning his garden in preparation for a party to celebrate his birthday.
He said that he had not intended to hit the garden gate, but had a wrist injury which had affected his throw.
District Judge Alexandra Preston questioned why Howard hadn't bagged up the waste and disposed of it correctly.
"Whether intentional or not, you behaved in a very anti-social way", she told him.
Howard was ordered to pay £150 in compensation and £85 in prosecution costs.
